Airteach, Inc (“Airteach”, “we”, “us”, “our”) respects your privacy and is committed to being transparent with you about how we handle personal information. This Privacy Policy explains how Airteach collects, uses, and shares information about you when you use the Airteach Platform (“Platform”), or otherwise interact with us. It also goes over how you can exercise your privacy rights and choices. The Platform is designed to allow our customers to build, design, publish, and sell courses, coaching and other services to their members. 1. Personal Information We Collect and How We Use it

We may collect and use the following personal information.

Personal Information You Provide to Us

We collect personal information you directly provide to us. We may also receive personal information about you from others; e.g. from another user or our payment processors.

Your Personal Details. Such as your first and last name (or full name), email address, phone number, job title, and other contact information you provide.

Account and Other Identifiers. For example, a username, screen name, handle, account ID, assigned user ID, customer number, or similar identifier that can be used to identify a user or account.

User Content. For example, emails and text messages, photos, videos, audio recordings, customer support communications, comments/feedback, and any other content submitted by you.

Survey Data. We may contact some individuals to request participation in a survey or other general research. If you choose to take part in these, you may provide personal information, in or along with your survey responses, or in any other feedback or comments you give us.

Messages and Email Data. We collect information about you when you send, receive, open, read or otherwise engage with messages, email, or other communications in connection with our Platform, including whether you have opened or acted on those communications.

Other Personal Information You Provide. If you provide us personal information other than that described above, we will collect it and use it for the purposes for which you provide it or other consistent purposes.

Payment Processing Information. For example, the form of payment, payment card number and details, bank account number, payment service provider, and other payment information you provide.

Personal Information We Collect Automatically

Whenever you interact with our platform, we automatically receive and collect certain information.

Usage Data. Airteach logs usage information when you visit and use our Platform. This information may include IP address, browser type, operating system, and other information about the use of our website, such as the pages you viewed, when you viewed them, and links that were clicked.

Cookies and Similar Technology. Airteach may collect information about you through the use of cookies and other similar technologies. Cookies are pieces of data in the form of text files that your browser stores on your hard drive and sends back to us when making requests, and similar technologies.

Approximate Location. We may receive and process information about your approximate location. For example, we may be able to determine your approximate location from your IP address and other information about you. Airteach does not ask for or track any precise location-based information.

You may be able to change the preferences on your browser or mobile device to send “do not track” signals or to prevent or limit your computer or device’s acceptance of cookies, but this may prevent you from taking advantage of some of our Platform’s features. If you click on a link to a third party website, such third party may also transmit cookies to you. This privacy policy does not cover the use of cookies by any third parties.

Personal Information We Collect From Others

We mostly collect personal information directly from you or based on your interaction with our Platform. However, we also may collect personal information from third-party sources.

Single sign-on services. We may offer single sign-on services that allow you to use third party login credentials to sign into our platform. With your permission, Airteach may also collect profile information contained in your third-party profile. Airteach may also, for your use, enable you to import information about who you are connected to, as well as enable you to share information with those third-party sites.

Marketing sites on third-party platforms. We may also maintain pages for our company and our products on a variety of third-party platforms, such as Facebook, Twitter, Google+, YouTube, Instagram, and other social networking services. When you interact with our pages on those third-party platforms, the third-party’s privacy policy will govern your interactions on the relevant platform. If the third party platform provides us with information about our pages on those platforms or your interactions with them, we will treat that information in accordance with this privacy policy.

How We Use Personal Information We Collect

Our primary purposes for using your personal information are to provide you with a smooth, efficient, and customized experience, for customer support, advertising and marketing communications, research and service development, and to keep our platform and users safe and secure. Specifically, we may use your information for the following business purposes:

To provide and improve our services. We use personal information that we collect about you to allow you to access our Platform and to provide you with the services you request.

For customer support. We use personal information to investigate, respond to, and resolve customer queries, send you technical notices and security alerts, and provide other support and administrative services.

For advertising and marketing communications. We use personal information to develop targeted advertising both on and off our Platform, and to communicate with you about our products, services, offers and promotions.

For research and service development. We use personal information to conduct market research and to develop new services in order to provide you with a better experience and to drive growth in our business.

For legal and security purposes. We use personal information to prevent, detect, investigate, and take measures against criminal activity, fraud, misuse of or damage to our Platform or network, and other threats and violations to Airteach’s or a third party's rights.

How We Share Personal Information We Collect

Airteach only shares your personal information with third parties under the circumstances described below. We do not sell or otherwise disclose personal information we collect about you for monetary or other valuable consideration.

Sharing of Student Information with Creators

When you enroll in a creator product (or course), Airteach will share certain personal information about you with the creator to allow the creator to provide you with their services. The set of personal information that we share with creators is limited to the following:

1. Account information, including your name and email address.

2. Purchase information, including amount paid, your address, and other billing information (but never your complete card number, which we do not collect).

3. IP address.

4. Information about your participation in the creator product, including the lecture completion status, course progress, quiz results, and certificates.

5. Any messages you exchange with the creator through Airteach will only provide student data to a creator upon a purchase by or enrollment of a student in the creator’s content.

Airteach does not disclose any other types of personal information about Students to Creators. Any additional personal information that is shared by a Student with a Creator is done so at the discretion of the Student. The Creator is responsible for protecting Students’ personal information that they collect and processing that information in accordance with applicable data protection laws. Students who have questions about Creators’ privacy practices should contact the Creators directly and ask to review the Creators’ privacy policies.

Sharing of Creator Information with Students and Other Users

When you (as a creator) publish a product, information contained in the product will be viewable to users who are given access to. For example, when you publish your bio on a sales page, personal information in your bio will be viewable to persons who visit your sales page.

Please keep in mind that all of the information that you share or content that you publish in your bio, posts, comments, or other public portions of our Platform becomes public information. Because this information is publicly available, we cannot control how others treat it. We ask you to exercise care in deciding what personal information you choose to share, and refrain from sharing your sensitive personal information and those of others.

We may also share your personal information in the following ways:

With Your Consent: Airteach may send your personal information to a third party when you give us consent to do so or at your direction. For example, this may occur when we complete a transaction at your request.

With Service Providers: We may share personal information with vendors, consultants, payment processors, and other service providers that provide us with certain services and process personal information on our behalf. These services may include providing customer support, performing business and sales analysis, supporting our website functionality, facilitating payment processing, and supporting contests, surveys, and other features offered on our Platform. These service providers are not permitted to use your personal information for any other purpose, and their use of such personal information will be subject to appropriate confidentiality and security measures.

With Business Partners: We sometimes partner with third parties to offer you events, promotions, contests and other programs. To participate in these offers, you may be required to provide your email address and other personal information. We will only share your email address and other personal information with a business partner when you expressly authorize us to do so.

With Advertising and Analytics Partners: We may share usage data with third-party advertisers, advertisement networks, and analytics providers through cookies and other similar technologies. These third parties may collect information sent by your computer, browser, or mobile device in response to a request for content, such as unique identifiers, your IP address, or other information about your computer or device. Legal Disclosures: Airteach may be required to disclose personal information if directed by a court of law or other governmental entity. Without limiting the foregoing, we reserve the right to disclose such information where we have a good faith basis to believe that such action is necessary to:

- comply with applicable laws, regulations, court orders, government and law enforcement agencies’ requests;

- protect and defend Airteach’s or a third party's rights and property, or the safety of Airteach, our users, our employees, or others; or

- prevent, detect, investigate and take measures against criminal activity, fraud and misuse or unauthorized use of our Platform and/or to enforce our terms of service or other agreements or policies.

To the extent permitted by law, we will attempt to give you prior notice before disclosing your information in response to such a request.

We may share your information for reasons not described in this policy. We will tell you before we do this.

2. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure of your personal information; the purposes for which we process your personal information and whether we can achieve those purposes through other means; and the applicable legal requirements. In some circumstances, you may ask us to delete your information. Additionally, we may anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

3. Jurisdiction Specific Privacy Provisions

Users in the European Economic Area, United Kingdom, and Switzerland

Under the General Data Protection Regulation (“GDPR”) and other applicable laws, users in the European Economic Area (“EEA”), United Kingdom (UK), and Switzerland have the right to, under certain conditions, request access to, rectification of, or erasure of their personal information; request restriction of processing; object to processing; withdraw consent from processing; data portability; and submit a complaint to a data protection authority.

Please include the phrase “GDPR request” in the subject line and provide us with your mailing address and country of residence.

Airteach only collects and processes personal information about you where it has lawful bases for doing so. The specific legal basis applied to the processing will depend on the context in which the personal information is being processed, including the service used and the type of personal information involved. Airteach uses the following legal bases for processing:

For the performance of a contract. We will process your personal information to fulfill our contractual obligations with you, to communicate with you regarding your use of our Platform, and to comply with our terms of service.

For legitimate interests. We will process your personal information for our legitimate interests or those of others (as long as the processing is not outweighed by your data protection interests). This includes but is not limited to, preventing fraud and other abuse, ensuring the security of our Platform, protecting our legal rights and interests, conducting market research and product development, and for marketing purposes.

For advertising and marketing communications. We use personal information to develop targeted advertising both on and off our Platform, and to communicate with you about our products, services, offers and promotions.

To comply with legal obligations. We will process your personal information to comply with all applicable laws, regulations, court orders, and government and law enforcement agencies’ requests.

Consent. We will process your personal information when you have given us consent to do so, such as when you consent to receive certain communications from us.

If you’d like to withdraw your consent or object to our processing of your personal information, please contact support@airteach.io. If you believe that we have not adequately addressed your concerns or wish to report an alleged infringement of applicable data privacy laws, you may file a complaint with your local supervisory authority.

4. Children’s Privacy

Our Service is not designed for use by anyone under the age of 13 ("Children"). If you are between the ages of 13 and 18, you must have your parent or guardian’s permission to use the Platform.

We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your children have provided us with personal Information, please contact us at support@airteach.io. If we become aware that we have collected Personal Information from children under age 13 without verification of parental consent, we take steps to remove that information from our servers.

5. International Transfer

Airteach is headquartered in the United States and has service providers in other countries, and your personal information may be transferred to the United States or other locations outside of your state, province, country or other governmental jurisdiction depending on the location of its affiliates and service providers.

If you use our Platform outside the United States, including in the EEA, UK, and Switzerland, your information will be transferred to, stored, and processed in the United States. By accessing our Platform or otherwise giving us information, you consent to the transfer of information to the United States and other countries outside your country of residence.

6. Third Parties

Except as otherwise expressly included in this privacy policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether between creator and member or with other users, different rules may apply to how they use and share your personal information. Airteach does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your Personal Data to others.

7. Use for New Purposes

When we act as a data controller, we may use your personal information for reasons not described in this privacy policy where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

8. Policy Changes

We keep this privacy policy under regular review, so the terms of this policy may change from time to time. If we make material changes to how we treat our users’ personal data, we will notify you by posting the revised policy on this website or by other means when appropriate. Your continued use of this website constitutes your consent to such revised privacy policy.
